font-size: medium;\"><strong><em>as Adopted 1\/18\/10 on Second Reading <\/em><\/strong><\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\"><strong><span style=\"text-decoration: underline;\">VOTER ID &#8211; Effective as of January 2, 2012<\/span><\/strong><\/span><\/p>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Requires a person to present a valid and current: <\/span>\n<ul>\n<li>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">SC driver\u2019s license;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">SC identification card issued by DMV;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Passport;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Military identification issued by the federal government (with photograph);<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Employee identification card issued by the federal or state government or a SC political subdivision (with photograph);<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">SC voter registration card containing a photograph of the voter (when this process becomes available).<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">One of the managers must compare the photograph on the id with the person wishing to vote to verify the photo is the person wishing to vote.<\/span><\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">If the elector cannot produce identification, he can cast a provisional ballot to be counted if identification is presented to the board of voter registration prior to certification.\u00a0<em><\/em><\/span><\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">An elector with either a:<\/span><\/li>\n<\/ul>\n<ul><span style=\"font-family: 'Times New Roman'; font-size: small;\"> (i) religious objection to being photographed or<\/span><\/ul>\n<ul><span style=\"font-family: 'Times New Roman'; font-size: small;\">(ii) reasonable impediment that prevents the elector from obtaining a photo id may cast a provisional ballot and complete an affidavit at the poling precinct.\u00a0 The affidavit would be included with the provisional ballot. <\/span><\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">If the county board of registration and elections determines that a voter was challenged solely for the inability to produce required identification and an affidavit is submitted, the ballot will be valid unless the board has other grounds to believe the affidavit is false. <\/span><\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">DMV would issue free identification cards, upon request for individuals aged 17 years &amp; older.\u00a0 The $5 fee would still apply to persons between the ages of 5-16.\u00a0\u00a0<strong><em>Note:\u00a0 this provision will be effective on January 2, 2011.<\/em><\/strong><\/span><\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">The State Elections Commission will implement a system to issue voter registration cards with the elector\u2019s photograph.\u00a0\u00a0<strong><em>Note:\u00a0 Effective on July 1, 2011 and to be implemented as funding becomes available.<\/em><\/strong><\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\"><strong><span style=\"text-decoration: underline;\">EARLY VOTING &#8211; Effective as of January 2, 2012<\/span><\/strong><\/span><\/p>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Early voting period begins 15 days before an election &amp; ends 3 days before.<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Elector can cast early ballot (without excuse) at an early voting center in his county of residence.<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Every county board of registration and elections must establish at least 1 early voting center.\u00a0 The board will determine the hours of operation and location for the center, but the center must be open at least one Saturday during the early voting period for statewide primaries and general elections. <\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Early voting centers must be maintained to ensure voters can only cast one ballot. <\/span><\/li>\n<\/ul>\n<ul><span style=\"font-family: 'Times New Roman'; font-size: small;\"><strong><span style=\"text-decoration: underline;\">ABSENTEE BALLOT &#8211; Effective as of January 2, 2012<\/span><\/strong><\/span><\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">A paper absentee ballot can be cast at anytime during the absentee ballot period.\u00a0 Alternatively, a voter may cast an absentee ballot using a voting machine, 30-16 days before an election.<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">A person who, within 4 days of the election, is:<\/span><\/li>\n<\/ul>\n<ul>\n<li>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Admitted to the hospital as an emergency patient;<\/span><\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">discovered unanticipated employment obligations would require the person to be at his place of employment on election day;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">has a death or funeral in the family;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">confined in correctional facility pending arrest disposition<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">can request an application to vote absentee.\u00a0 This request can be made by the elector, a \u00a0member of the elector\u2019s immediate family or authorized representative on the day before \u00a0the election.\u00a0 If a family member or representative receives the ballot, that person must \u00a0personally deliver the ballot and return the ballot to the board of registration by the time \u00a0the polls close on election day.<\/span><\/p>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Various technical changes to clarify existing law.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\"><strong><span style=\"text-decoration: underline;\">RESIDENCY REQUIREMENTS &#8211; Effective upon preclearance<\/span><\/strong><\/span><\/p>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Place current factors to consider for residency if vote challenged under section where residency\/domicile is defined.\u00a0 Current factors include:<\/span><\/li>\n<\/ul>\n<ul>\n<li>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Income tax returns;<\/span><\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Real estate interest;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Mailing address;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Address on driver\u2019s license;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Official documents requiring statement of residence address;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Auto registration;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Checking\/savings accounts;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Past voting record;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Membership of clubs\/organizations; and<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Location of personal property.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Added following factors:<\/span><\/li>\n<\/ul>\n<ul>\n<li>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Real estate interest, \u201cwith emphasis on the address used for the legal residence tax assessment ratio pursuant to \u00a7 12-43-220(C)\u201d;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Other ID issued by DMV (currently lists on drivers license);<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Spouse\u2019s residence;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Parents\u2019 residence;<\/span><\/li>\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Residency claimed for tuition for an educational institution.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul type=\"DISC\">\n<li><span style=\"font-family: 'Times New Roman'; font-size: small;\">Delete \u201celector\u2019s statements as to his intent\u201d<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\"><strong><span style=\"text-decoration: underline;\">PUBLIC EDUCATION PROCESS &#8211; Effective upon preclearance<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">The State Elections Commission must establish an aggressive voter education program concerning the provisions contained in this legislation.\u00a0 The following lists education programs to be provided\/coordinated by the State Elections Commission:<\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">(1)\u00a0Post information concerning changes contained in this legislation in a conspicuous location at each county board of registration and elections, each satellite office, the State Elections Commission office, and their respective websites.<\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">(2)\u00a0Train poll managers and poll workers at their mandatory training sessions to answer questions by electors concerning the changes in this legislation. <\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">(3)\u00a0Require documentation describing the changes in this legislation to be disseminated by poll managers and poll workers at every election held after September 30, 2010. <\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">(4)\u00a0Coordinate with each county board of registration and elections so that at least two seminars are conducted in each county prior to October 15, 2011. <\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">(5)\u00a0Coordinate with local and service organizations to provide for additional informational seminars at a local or statewide level.<\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">(6)\u00a0Place an advertisement describing the changes in this legislation in South Carolina newspapers of general circulation by no later than October 15, 2011. <\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">(7)\u00a0Coordinate with local media outlets to disseminate information concerning the changes in this legislation. <\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman'; font-size: small;\">(8)\u00a0Notify each registered elector who does not have a South Carolina issued driver\u2019s license or identification card a notice of the provisions of this act by no later than October 15, 2011.\u00a0 This notice must include the requirements to vote absentee, early or voting on election day and a description of voting by provisional ballot.\u00a0 It must also state the availability of a free South Carolina identification card pursuant to Section 56-1-3350.<\/span><\/p>\n<p><span style=\"font-family: 'Times New Roman';
